Section 217 — Administrative Review Tribunal Act 2024: Appearances before Tribunal

(1) A person covered by subsection (2) must not appear in a proceeding in the Tribunal: (a) as a representative of a party to the proceeding; or (b) as an expert witness in the proceeding. (2) The following persons are covered by this subsection: (a) a member; (b) a person who ceased to be a member during: (i) the 12 months before the day of the appearance; or (ii) if a law of a State or Territory has the effect of prescribing a longer period before the day of the appearance—that longer period. (3) Subsection (1) does not apply if the person has permission to appear in the proceeding from: (a) if the person is the President—the Minister; or (b) in any other case—the President.
