Section 291 — Administrative Review Tribunal Act 2024: Giving documents etc. to decision-maker

When section applies (1) This section applies if the Tribunal or any person is permitted or required under this Act to give a document or thing in relation to a decision to the decision-maker for the decision. Giving documents etc. to Secretary (2) The Tribunal or person may instead give the document or thing to the Secretary of the Department administered by the Minister who administers: (a) the Act under which the decision was made; or (b) if the decision was made under an instrument—the Act under which the instrument is made. Giving documents etc. to holder of office (3) If the holder of a particular office is prescribed by the rules, an Act or an instrument made under an Act as a person to whom documents or things may be given under this Act in relation to a class of decisions that includes the decision, the Tribunal or person may instead give the document or thing to the holder of that office. Note: Sections 28A and 29 of the Acts Interpretation Act 1901 deal with the manner in which the documents may be given.
