Section 40 — Administrative Review Tribunal Act 2024: Exception—President refers application for review that raises issue of significance

When this section applies (1) This section applies instead of section 39 in relation to a proceeding in the Tribunal in relation to an application referred to the guidance and appeals panel by the President under section 122. Note: The President may refer an application for review of a decision to the guidance and appeals panel if the President is satisfied that the application raises an issue of significance to administrative decision-making (see section 122). General rules (2) The Tribunal must be constituted for the purposes of the proceeding by 2 or 3 members. (3) One of the members must be the President or a Deputy President.
