Section 58 — Age Discrimination Act 2004: Protection from civil actions

(1) The Commission, the Commissioner or another member of the Commission, or a person acting for or on behalf of the Commission or the Commissioner or another member of the Commission, is not liable to an action or other proceeding for damages for or in relation to an act done in good faith: (a) in performance or purported performance of any function conferred on the Commission; or (b) in exercise or purported exercise of any power conferred on the Commission. (2) Subsection (3) applies if a submission has been made, a document or information has been given, or evidence has been given, to the Commission or to a person acting for or on behalf of the Commission. (3) A person is not liable to an action, suit or proceeding in respect of loss, damage or injury of any kind suffered by another person by reason only that the submission was made, the document or information was given or the evidence was given.
