Section 135L — Competition and Consumer Act 2010: Occupier etc. to provide inspector etc. with facilities and assistance

(1) A person commits an offence if: (a) the person is: (i) the occupier of premises to which a search warrant relates; or (ii) another person who apparently represents the occupier of those premises; and (b) the person fails to provide: (i) an inspector executing the warrant; and (ii) a person assisting the inspector; with all reasonable facilities and assistance for the effective exercise of their powers. Penalty: (a) if the person is a body corporate—600 penalty units; or (b) if the person is not a body corporate—120 penalty units or imprisonment for 2 years, or both. (2) Subsection (1) is an offence of strict liability. Note: For strict liability, see section 6.1 of the Criminal Code.
