Section 151AP — Competition and Consumer Act 2010: Guidelines

(1) In deciding whether to issue a competition notice, the Commission must have regard to: (a) any guidelines in force under subsection (2); and (b) such other matters as the Commission considers relevant. (2) The Commission must, by written instrument, formulate guidelines for the purposes of subsection (1). (3) Guidelines under subsection (2) must address the appropriateness of the Commission issuing a competition notice as opposed to the Commission taking other action under this Act. (4) The Commission must take all reasonable steps to ensure that guidelines under subsection (2) comply with subsection (3) within 12 months after the commencement of this subsection.
