Section 151CD — Competition and Consumer Act 2010: Finding of fact in proceedings to be evidence

(1) This section applies to a finding of any fact by a court made in proceedings under section 151BY, 151CA or 151CB in which a person has been found to have contravened, or to have been involved in a contravention of, the competition rule. (2) In: (a) a proceeding under section 151CC against the person; or (b) an application under subsection 151CE(1) for an order against the person; the finding: (c) is prima facie evidence of that fact; and (d) may be proved by production of a document under the seal of the court from which the finding appears.
