Section 152CBB — Competition and Consumer Act 2010: Further information about undertaking

(1) This section applies if a person gives a special access undertaking to the Commission. (2) The Commission may request the person to give the Commission further information about the undertaking. (2A) If: (a) the Procedural Rules make provision for or in relation to a time limit for giving the information; and (b) the person does not give the Commission the information within the time limit allowed by the Procedural Rules; the Commission may, by written notice given to the person, reject the undertaking. (2B) Subsection (2A) has effect despite anything in this Division. (2C) If the Commission makes a decision under subsection (2A) to reject the undertaking, subsection 152CBC(5) has effect as if the decision had been made under subsection 152CBC(2). (3) If the Procedural Rules do not make provision for or in relation to a time limit for giving the information, the Commission may refuse to consider the undertaking until the person gives the Commission the information. (4) The Commission may withdraw its request for further information, in whole or in part.
