Section 152CBDA — Competition and Consumer Act 2010: Variation of special access undertaking

(1) This section applies if a person gives a special access undertaking (the original undertaking) to the Commission. (2) The Commission may give the person a written notice stating that, if the person: (a) makes such variations to the original undertaking as are specified in the notice; and (b) gives the varied undertaking to the Commission within the period specified in the notice; the Commission will consider the varied undertaking under section 152CBC as if the varied undertaking had been given to the Commission instead of the original undertaking. (3) If the person gives the Commission a varied undertaking in response to the notice, the Commission must consider the varied undertaking under section 152CBC as if the varied undertaking had been given to the Commission instead of the original undertaking. (4) The Commission does not have a duty to consider whether to give a notice under subsection (2).
