Section 153ZEI — Competition and Consumer Act 2010: Ending negotiations under this Division

(1) The access seeker may give notice to the provider that the negotiation is at an end, whether or not the access seeker also refers or has referred a related access dispute to arbitration under this Part. (2) The provider may give notice to the access seeker that the negotiation is at an end for the purposes of this Part if the CS service ceases to be a declared CS service. Timing (3) The negotiation is taken to have ended for the purposes of this Part when the notice under subsection (1) or (2) is given. Notifying the Commission (4) If the negotiation ends under subsection (1) or (2), the following person must notify the Commission as soon as practicable: (a) if subsection (1) applies—the access seeker; (b) if subsection (2) applies—the provider.
