Section 191D — Competition and Consumer Act 2010: Post-supply fees not to be demanded or received

(1) A person commits an offence if the person, in trade or commerce, demands or receives payment of a post-supply fee in relation to a gift card. Penalty: (a) if the person is a body corporate—$30,000; or (b) if the person is not a body corporate—$6,000. (2) An offence against subsection (1) is an offence of strict liability.
