Section 201 — Competition and Consumer Act 2010: Notification requirements for a voluntary recall of consumer goods

(1) A person commits an offence if: (a) the person is required by section 128(2) to give a notice to the Commonwealth Minister; and (b) the person refuses or fails to give the notice as required by that section. Penalty: (a) if the person is a body corporate—$16,650; or (b) if the person is not a body corporate—$3,330. (2) A person commits an offence if: (a) the person is required by section 128(6) to give a copy of a notice to the Commonwealth Minister; and (b) the person refuses or fails to give the copy as required by that section. Penalty: (a) if the person is a body corporate—$16,650; or (b) if the person is not a body corporate—$3,330. (3) Subsections (1) and (2) are offences of strict liability.
