Section 51ABZC — Competition and Consumer Act 2010: Material changes of fact—providing additional information and documents

(1) This section applies in relation to a notification of an acquisition if: (a) the Commission has made a decision under subparagraph 51ABZB(2)(a)(ii) or paragraph 51ABZB(2)(b) in relation to the notification because of a material change of fact; and (b) the notifying party of the notification gives the Commission information or documents in response to the decision. (2) The information or documents are given in accordance with this subsection if: (a) in the case of information—the information is given in writing; and (b) the information or documents are accompanied by the fee (if any) determined under subsection (3) for the purposes of this paragraph in relation to the information or documents and the notification of the acquisition. (3) The Minister may, by legislative instrument, determine a fee for the purposes of paragraph (2)(b) in relation to the information or documents and the notification. (4) To avoid doubt, the information or documents are taken not to be given before the fee (if any) required by paragraph (2)(b) is paid.
