Section 51ABZX — Competition and Consumer Act 2010: Conditions

(1) A determination made under paragraph 51ABZW(1)(a) may include conditions. Example: A condition that a specified person must give an undertaking to the Commission for the purposes of section 87B and comply with the undertaking. (2) In considering whether to include conditions in a determination, the Commission: (a) must have regard to all relevant matters; and (b) may have regard to: (i) the effect on the interests of consumers that compliance with the conditions would have, or be likely to have; or (ii) without limiting subparagraph (i) of this paragraph—any consumer benefits that would result, or be likely to result from compliance with the conditions.
