Section 51ABZY — Competition and Consumer Act 2010: Public benefit

(1) This section applies in relation to the Commission considering, for the purposes of this Part, whether, were an acquisition put into effect: (a) the acquisition would, in all the circumstances, result, or be likely to result, in a benefit to the public; and (b) the benefit would, in all the circumstances, outweigh the detriment to the public that would result, or be likely to result, from the acquisition. (2) The Commission must have regard to all relevant matters. (3) Without limiting subsection (2), the Commission may have regard to the contract, arrangement or understanding, or proposed contract, arrangement or understanding, pursuant to which the acquisition is to take place.
