Section 58EB — Competition and Consumer Act 2010: General regulator of the Scams Prevention Framework

(1) The Commission is the SPF general regulator for all SPF provisions apart from the provisions of SPF codes. (2) The functions and powers of the SPF general regulator include: (a) reviewing, and advising the Minister about, the operation of the SPF provisions; and (ab) monitoring, investigating and enforcing compliance with the SPF provisions, other than the provisions of SPF codes; and (b) the Commission’s powers under section 155 to the extent that section 155 relates to: (i) the SPF provisions, other than the provisions of SPF codes; or (ii) a designated scams prevention framework matter (within the meaning of that section) of a kind not mentioned in subparagraph 58ED(3)(c)(ii); and (c) developing and publishing non-binding guidance material relating to the SPF provisions, other than the provisions of SPF codes; and (d) the functions and powers of the SPF general regulator conferred by any other SPF provisions. Note: Paragraph (d) includes the SPF general regulator’s powers under the Regulatory Powers Act that are referred to in Division 6.
