Section 58FZC — Competition and Consumer Act 2010: Actions for damages—general rule

(1) A person (the victim) who suffers loss or damage by conduct of another person that was done in contravention of: (a) a civil penalty provision of an SPF principle; or (b) a civil penalty provision of an SPF code; may recover the amount of the loss or damage by action against that other person. (2) An SPF regulator may make a claim under subsection (1) on behalf of the victim if the SPF regulator has the victim’s written consent to do so. (3) A claim under subsection (1) may be made at any time within 6 years after the day the cause of action that relates to the conduct accrued. (4) However, this section applies subject to sections 58FZD to 58FZK (about proportionate liability for concurrent wrongdoers). Note: See subsection 58FZF(1) in particular.
