Section 1023G — Corporations Act 2001: Commencement and duration of product intervention orders

Commencement of product intervention orders (1) A product intervention order comes into force: (a) for an order that is a legislative instrument—on the day after the instrument is registered under the Legislation Act 2003; or (b) otherwise—on the day after the notice under subsection 1023L(3) in relation to the order is published; or a later day specified in the order. Duration of product intervention orders (2) A product intervention order remains in force for: (a) 18 months, or any shorter period specified by the regulations; or (b) any shorter period specified in the order. However, if the Court makes an order staying or otherwise affecting the operation or enforcement of a product intervention order, then, in determining when the period referred to in paragraph (a) or (b) ends, disregard the period during which the Court’s order has that effect. (3) Subsection (2) does not apply to a product intervention order if a declaration under section 1023H (which relates to extensions of product intervention orders) is in force in relation to the order. (4) Subsection (2) does not prevent the revocation of a product intervention order. Repeal of product intervention orders (5) A product intervention order that is a legislative instrument that ceases to be in force is repealed by force of this subsection.
