Section 1074C — Corporations Act 2001: Operating rules of prescribed CS facility may deal with transfer of title

(1) The operating rules of a prescribed CS facility may deal with the transfer of financial products through the facility. (2) Without limiting subsection (1), the operating rules of a prescribed CS facility may deal with the way in which a financial product may be transferred, including specifying: (a) the financial products that may be transferred through the facility; and (b) how financial products are transferred through the facility; and (c) the person or body (if any) authorised to determine whether a transfer substantially complies with the operating rules of the facility. (3) Nothing in subsection (1) or (2) confers a discretion to deal with a matter in the operating rules of a prescribed CS facility if there is an obligation under section 822A for that matter to be dealt with in those rules.
