Section 1200Q — Corporations Act 2001: Offence of breaching an ongoing condition

(1) A person commits an offence if, at any particular time: (a) the person is the offeror of a recognised offer; and (b) an offering condition in section 1200G applies in relation to the offer; and (c) the condition is not met in relation to the offer. (2) A person commits an offence if: (a) the person is or has been the offeror of a recognised offer; and (b) at any particular time: (i) the address for service condition in section 1200H; or (ii) the dispute resolution condition in section 1200J; applies in relation to the offer; and (c) the condition is not met in relation to the offer.
