Section 1214 — Corporations Act 2001: Register of Passport Funds

(1) ASIC must either: (a) establish and maintain a Register of Passport Funds; or (b) ensure that a Register of Passport Funds is established and maintained. (2) If the Register of Passport Funds is established and maintained by ASIC, ASIC may do so in any form that ASIC considers appropriate. (3) The Register of Passport Funds: (a) must include the prescribed details of Australian passport funds and notified foreign passport funds; and (b) must include the prescribed details of funds that have been deregistered as Australian passport funds and funds that have been removed as notified foreign passport funds; and (c) may include details of other passport funds. (4) For the purposes of the Corporations legislation, a reference to a register kept by ASIC under this Act is taken to include a Register of Passport Funds that ASIC ensures is established and maintained under paragraph (1)(b).
