Court may appoint receiver etc. of any or all of a sub-fund’s property (1) Paragraph 233(1)(h) has effect in relation to a CCIV as if the reference in that paragraph to the company’s property were instead a reference to the property of a sub-fund of the CCIV. Note: A receiver may only be appointed in relation to property of a particular sub-fund of a CCIV: see section 1236B. Order altering constitution (2) Subsection 233(3) applies to a CCIV as if the reference to section 136 were instead a reference to: (a) if the CCIV is a retail CCIV—section 1223D; or (b) if the CCIV is a wholesale CCIV—the CCIV’s constitution.
