Section 1228D — Corporations Act 2001: Copy of the register of members—sub-funds

(1) Subsection 252C(3) does not apply in relation to a CCIV or a sub-fund of a CCIV. (2) To call a meeting of the members of a CCIV, the members requesting the meeting may ask the CCIV under section 173 for a copy of the register of members. (3) To call a meeting of the members of a sub-fund of a CCIV, the members requesting the meeting may ask the CCIV under section 173 for a copy of so much of the register of members as relates to membership of the sub-fund. (4) Despite paragraph 173(3)(b), the CCIV must, without charge, give the members requesting the meeting: (a) if subsection (2) of this section applies—the copy of the register; or (b) if subsection (3) of this section applies—so much of the register of members as relates to membership of the sub-fund. (5) An offence based on subsection (4) is an offence of strict liability.
