Section 769C — Corporations Act 2001: Representations about future matters taken to be misleading if made without reasonable grounds

(1) For the purposes of this Chapter, or of a proceeding under this Chapter, if: (a) a person makes a representation with respect to any future matter (including the doing of, or refusing to do, any act); and (b) the person does not have reasonable grounds for making the representation; the representation is taken to be misleading. (2) Subsection (1) does not limit the circumstances in which a representation may be misleading. (3) In this section: proceeding under this Chapter has the same meaning as it has in section 769B.
