Section 157V — Environment Protection and Biodiversity Conservation Act 1999: Minister may request further information for making decision

(1) The Minister may request any of the following persons to provide specified information if the Minister is satisfied that the information is reasonably necessary in order for the Minister to make an informed decision as to whether to grant, vary, revoke or accept the surrender of a national interest exemption for an action: (a) the applicant for the decision (if any); (b) if there is no applicant—the person who proposes to take, is taking or has taken the action, or who is the designated proponent of the action; (c) in any case—the person to whom the exemption applies or is proposed to apply; (d) any other person the Minister considers appropriate. (2) If the Minister has requested information under subsection (1) in respect of a decision for which there is an applicant, a day is not to be counted as a business day for the purposes of subsection 157K(3) (application for exemption), 157Q(3) (application to vary exemption) or 157U(2) (application to surrender exemption) if it is: (a) on or after the day the Minister requested the information; and (b) on or before the day on which the Minister receives the last of the information requested.
