Section 321 — Environment Protection and Biodiversity Conservation Act 1999: Co-operating to prepare and implement plans

(1) This section applies in relation to a property that is included in the World Heritage List. (2) The Commonwealth must use its best endeavours to ensure a plan for managing the property in a way that is not inconsistent with Australia’s obligations under the World Heritage Convention or the Australian World Heritage management principles is prepared and implemented in co-operation with the State or Territory. Note: The Commonwealth and the State or Territory could make a bilateral agreement adopting the plan and providing for its implementation. (3) Subsection (2) does not apply in relation to so much of a property as is in the Great Barrier Reef Marine Park. Note: A zoning plan must be prepared under the Great Barrier Reef Marine Park Act 1975 for areas that are part of the Great Barrier Reef Marine Park. In preparing a zoning plan, regard must be had to the Australian World Heritage management principles.
