Section 37D — Environment Protection and Biodiversity Conservation Act 1999: Declarations relating to declared World Heritage properties

The Minister may make a declaration under section 37A relating to a declared World Heritage property only if: (a) the Minister is satisfied that the declaration is not inconsistent with Australia’s obligations under the World Heritage Convention; and (b) the Minister is satisfied that the declaration will promote the management of the property in accordance with the Australian World Heritage management principles; and (c) the Minister is satisfied that the declaration is not inconsistent with a plan that has been prepared for the management of the declared World Heritage property under section 316 or as described in section 321.
