Section 168B — Fair Work Act 2009: The modern enterprise awards objective

What is the modern enterprise awards objective? (1) The FWC must recognise that modern enterprise awards may provide terms and conditions tailored to reflect employment arrangements that have been developed in relation to the relevant enterprises. This is the modern enterprise awards objective. When does the modern enterprise awards objective apply? (2) The modern enterprise awards objective applies to the performance of the FWC’s functions or powers under this Act, so far as they relate to modern enterprise awards. References to the modern awards objective (3) A reference to the modern awards objective in this Act, other than section 134, is taken to include a reference to the modern enterprise awards objective.
