Section 276 — Fair Work Act 2009: When a workplace determination operates etc.

(1) A workplace determination operates from the day on which it is made. (2) A workplace determination ceases to operate on the earlier of the following days: (a) the day on which a termination of the determination comes into operation under section 224 or 227 as applied to the determination by section 279 (which deals with the application of this Act to workplace determinations); (b) the day on which subsection 278(1) or (2) first has the effect that there is no employee to whom the determination applies. Note: Subsections 278(1) and (2) deal with when a workplace determination ceases to apply to an employee. (3) A workplace determination that has ceased to operate can never operate again.
