Section 457 — Fair Work Act 2009: Results of protected action ballot

(1) As soon as practicable after voting in the protected action ballot closes, the protected action ballot agent must, in writing: (a) make a declaration of the results of the ballot; and (b) inform the following persons of the results: (i) each applicant for the protected action ballot order; (ii) the employer of the employees who were balloted; (iii) the FWC. (2) The FWC must publish the results of the protected action ballot, on its website or by any other means that the FWC considers appropriate, as soon as practicable after it is informed of them.
