Section 520 — Fair Work Act 2009: Affected member certificates

(1) The FWC must, on application by an organisation, issue a certificate (an affected member certificate) to the organisation if the FWC is satisfied that: (a) a member of the organisation performs work on particular premises; and (b) the organisation is entitled to represent the industrial interests of the member; and (c) a suspected contravention of a kind referred to in subsection 481(1) relates to, or affects, the member. (2) An affected member certificate must state the following: (a) the premises to which it relates; (b) the organisation to which it relates; (c) particulars of the suspected contravention, or contraventions, to which it relates; (d) that the FWC is satisfied of the matters referred to in paragraphs (1)(a), (b) and (c). (3) An affected member certificate must not reveal the identity of the member or members to whom it relates.
