Section 684 — Fair Work Act 2009: Directions from the Minister

(1) The Minister may, by legislative instrument, give written directions to the Fair Work Ombudsman about the performance of his or her functions. Note: Section 42 (disallowance) and Part 4 of Chapter 3 (sunsetting) of the Legislation Act 2003 do not apply to the direction (see regulations made for the purposes of paragraphs 44(2)(b) and 54(2)(b) of that Act). (2) The direction must be of a general nature only. (3) The Fair Work Ombudsman must comply with the direction. (4) The Fair Work Ombudsman is not required to comply with the direction to the extent that it relates to the Fair Work Ombudsman’s performance of functions, or exercise of powers, under the Public Service Act 1999 in relation to the Office of the Fair Work Ombudsman.
