Section 122 — Federal Circuit and Family Court of Australia Act 2021: Certification of retired disabled Judges

(1) If: (a) a Judge retires; and (b) the Judge has not attained the age of 70 years; the Minister may be requested to certify that the Judge is a retired disabled Judge. (2) On receiving the request, the Minister must: (a) if the Minister is satisfied that the retirement was due to permanent disability or infirmity—certify that the Judge is a retired disabled Judge; or (b) otherwise—refuse to so certify. (3) Applications may be made to the Administrative Review Tribunal for review of decisions of the Minister to refuse to so certify.
