Section 115 — National Disability Insurance Scheme Act 2013: Liability to pay the Agency if there is a contravention of section 114

(1) A potential compensation payer or insurer who contravenes section 114 is, in addition to being liable under that section, liable to pay to the Agency: (a) if the contravention relates to a notice under section 109—an amount determined by the CEO; or (b) if the contravention relates to a notice under section 111—the amount specified in the notice. (2) The amount determined by the CEO under paragraph (1)(a) must not be more than the amount that would have been specified in a notice under section 111 if one had been given. (3) This section applies in relation to a payment by way of compensation in spite of any law of the Commonwealth, a State or Territory (however expressed) under which the compensation is inalienable. (4) The amount determined by the CEO under paragraph (1)(a) or specified in the notice under section 111 is a debt due by the compensation payer or the insurer to the Agency.
