Section 117 — National Disability Insurance Scheme Act 2013: National Disability Insurance Agency

(1) The body that was established by this section as previously in force by the name National Disability Insurance Scheme Launch Transition Agency is now to be known as the National Disability Insurance Agency. Note: Subsection 25B(1) of the Acts Interpretation Act 1901 provides that a body whose name is altered by an Act continues in existence under the new name so that its identity is not affected. (2) The Agency: (a) is a body corporate; and (b) must have a seal; and (c) may acquire, hold and dispose of real and personal property; and (d) may sue and be sued. Note: The Public Governance, Performance and Accountability Act 2013 applies to the Agency. That Act deals with matters relating to corporate Commonwealth entities, including reporting and the use and management of public resources. (3) The seal of the Agency is to be kept in such custody as the Board directs and must not be used except as authorised by the Board.
