Section 173 — National Disability Insurance Scheme Act 2013: Giving certain information to the Ministerial Council

(1) The Board members must give the Ministerial Council a copy of each of the following when, or as soon as practicable after, the Board members give the copy to the Minister or the Finance Minister: (a) information, a report or a document given to the Minister or the Finance Minister under paragraph 19(1)(b) of the Public Governance, Performance and Accountability Act 2013; (b) particulars of a decision or issue notified to the Minister under paragraph 19(1)(c), (d) or (e) of that Act; (c) an annual report given to the Minister under section 46 of that Act. (1A) If the Board members inform the Minister of activities under paragraph 19(1)(a) of that Act, the Board members must also inform the Ministerial Council of the activities. (2) The Board members must cause a copy of information the Agency gives the Minister or a host jurisdiction Minister under section 175 to be given to the Ministerial Council as soon as practicable after the Agency gives the information to that Minister. (3) As soon as practicable after any of the following events happens to a person, the Board members must tell the Ministerial Council that the event has happened to the person: (a) appointment of the person as the CEO by the Board; (b) resignation of the person as the CEO; (c) termination of the person’s appointment as the CEO.
