Section 195 — National Disability Insurance Scheme Act 2013: Waiver in special circumstances

The CEO may waive the right to recover a debt if: (a) the debt did not result wholly or partly from the debtor or another person knowingly: (i) making a false or misleading statement or representation; or (ii) failing or omitting to comply with this Act, the regulations or the National Disability Insurance Scheme rules; and (b) there are special circumstances (other than financial hardship alone) that the CEO is satisfied make waiver appropriate; and (c) the CEO is satisfied that waiver is more appropriate than writing off the debt.
