Section 32 — National Disability Insurance Scheme Act 2013: CEO must facilitate preparation of participant’s plan

Initial plan (1) If a person becomes a participant, the CEO must facilitate the preparation of the participant’s plan. (2) The CEO must commence facilitating the preparation of the participant’s plan under subsection (1) within 21 days of the person becoming a participant. Subsequent plans (3) The CEO must also facilitate the preparation of a plan for a participant if: (a) the CEO decides under subparagraph 48(7)(b)(ii) or 49(1)(b)(ii) to prepare a new plan with the participant; or (b) the CEO gives the participant notice under subsection 32B(2) that the participant is to have new framework plans. (4) The CEO must commence facilitating the preparation of the participant’s plan under subsection (3): (a) unless paragraph (b) applies—as soon as practicable after the event mentioned in paragraph (3)(a) or (b) occurs; or (b) if the National Disability Insurance Scheme rules specify a number of days for the purposes of this paragraph—within that number of days after the day the event mentioned in paragraph (3)(a) or (b) occurs. Note: The CEO may suspend the preparation of a new framework plan if information or reports requested for the purposes of the undertaking of an assessment under section 32L are not received (see subparagraph 36(3)(b)(i)).
