Section 55A — National Disability Insurance Scheme Act 2013: Power of Commissioner to obtain information from other persons to ensure the integrity of the National Disability Insurance Scheme etc.

(1) If the Commissioner reasonably believes that a person, other than a prospective participant or a person receiving supports or services from an NDIS provider, has information, or has custody or control of a document, that may be relevant to one or more of the matters mentioned in subsection (2), the Commissioner may require the person to give the information, or produce the document, to the Commissioner. (2) The matters are as follows: (a) whether an NDIS provider is contravening or has contravened subsection 73B(2) (requirement to be a registered NDIS provider); (b) whether a person applying for registration under subsection 73E(1) satisfies the requirements mentioned in that subsection; (c) whether a registered NDIS provider is meeting or has met the conditions of registration mentioned in subsection 73F(1); (d) whether an NDIS provider, a person who is or was employed or otherwise engaged by an NDIS provider or a person who is or was a member of the key personnel of an NDIS provider is complying or has complied with the requirements of the NDIS Code of Conduct; (e) if an NDIS provider, or other person, is or was subject to a banning order—whether the provider or person is providing or has provided supports or services, or engaged in activities, in contravention of the order; (f) the functions of the Commissioner.
