Section 58 — National Disability Insurance Scheme Act 2013: Obligations not affected by State or Territory laws

(1) Subject to subsection (2), nothing in a law of a State or a Territory prevents a person from: (a) giving information; or (b) producing a document; or (c) giving evidence; that the person is required to give or produce to the Agency, an Agency officer, the Commissioner or a Commission officer for the purposes of this Act. (2) Despite subsection (1), a person is not required to give information, produce a document or give evidence to the Agency, an Agency officer, the Commissioner or a Commission officer for the purposes of this Act if: (a) the person would, apart from subsection (1), be prevented from doing so under a law of a State or Territory; and (b) the law of the State or Territory is prescribed by the National Disability Insurance Scheme rules for the purposes of this paragraph.
