Section 73C — National Disability Insurance Scheme Act 2013: Application to be a registered NDIS provider

(1) A person may apply to the Commissioner to be a registered NDIS provider in relation to one or more of the following: (a) the provision of supports or services under the arrangements set out in Chapter 2; (b) managing the funding for supports under participants’ plans; (c) the provision of supports under participants’ plans. Note: An unincorporated association or a partnership may also apply for registration under this section (see section 203). (2) A person may also apply to the Commissioner to be a registered NDIS provider in relation to the provision of services or supports to people with disability other than under the National Disability Insurance Scheme if the person is included in a class of persons prescribed for the purposes of subparagraph (b)(ii) of the definition of NDIS provider. (3) The application must: (a) be in writing; and (b) be in a form (if any) approved in writing by the Commissioner; and (c) include any information, and be accompanied by any documents, required by the Commissioner. Note: The Commissioner is not required to make a decision on the application if this subsection is not complied with (see section 197B). (4) The Commissioner may, by written notice, require an applicant for registration to give the Commissioner such further information or documents in relation to the application as the Commissioner reasonably requires. Note: The Commissioner is not required to make a decision on the application if this subsection is not complied with (see section 197B). (5) A notice under subsection (4) may specify a period, which must not be less than 14 days, within which the information or documents must be given. Withdrawal of application (6) An applicant for registration may at any time, by writing to the Commissioner, withdraw the application. (7) A person’s application is taken to have been withdrawn if the person’s registration is revoked under section 73P while that application is pending.
