Section 115Y — Paid Parental Leave Act 2010: Infringement notice not required to be served

This Division does not: (a) require an infringement notice to be served on a person in relation to an offence; or (b) affect the liability of a person to be prosecuted for an offence if: (i) an infringement notice is not served on the person in relation to the offence or in relation to any other offence constituted by the same omission; or (ii) an infringement notice served on the person in relation to the offence or in relation to any other offence constituted by the same omission has been withdrawn; or (c) affect the liability of a person to be prosecuted for an offence if the person does not comply with an infringement notice served on the person in relation to the offence or in relation to any other offence constituted by the same omission; or (d) limit the amount of the penalty that may be imposed by a court on a person convicted of an offence.
