Section 172 — Paid Parental Leave Act 2010: PPL funding amount debts—debts owing by employers to employees

(1) This section applies if: (a) a PPL funding amount is paid to an employer in relation to an instalment that is payable to a person; and (b) the instalment, or part of the instalment, is not paid to, or in relation to, the person in accordance with the following provisions: (i) section 70 (which deals with unauthorised deductions from instalments); (ii) Division 2 of Part 3-2 (which deals with the payment of instalments by employers). (2) So much of the instalment as is not paid to, or in relation to, the person in accordance with section 70 and Division 2 of Part 3-2, or as arrears under section 85, 86 or 87, is a debt due to the person by the employer, and is recoverable by the person in a court of competent jurisdiction.
