Section 98 — Paid Parental Leave Act 2010: Exemption from operation of workers’ compensation and accident compensation laws

(1) The payment of an instalment of parental leave pay is not to be taken into account for the purposes of the following provisions or laws: (a) a provision of a law of the Commonwealth, a State or a Territory, if the provision deals with: (i) workers’ compensation; or (ii) accident compensation; (b) a law, or a provision of a law, prescribed by the PPL rules, to the extent that the law or provision deals with a matter referred to in paragraph (a). (2) The PPL rules may provide that subsection (1) does not apply in relation to a prescribed provision of a law of the Commonwealth, a State or a Territory.
