Section 80D — Privacy Act 1988: Commissioner may continue to consider application

(1) The fact that the Commissioner has made a determination under this Division about an act or practice does not prevent the Commissioner from dealing under Division 1 with an application made under section 73 in relation to that act or practice. (2) A determination under this Division about an act or practice ceases to be in effect when: (a) a determination made under subsection 72(2) about the act or practice comes into effect; or (b) a determination is made under paragraph 78(b) to dismiss the application.
