Section 1061ZR — Social Security Act 1991: Duration of newly arrived resident’s waiting period

(1) Subject to subsection (2), if a person is subject to a newly arrived resident’s waiting period, the period: (a) starts on the day on which the person first became an Australian resident or a special category visa holder residing in Australia; and (b) ends when the person has been both: (i) an Australian resident or a special category visa holder residing in Australia; and (ii) in Australia; for a period of, or for periods totalling, 208 weeks. (2) If: (a) a person is subject to a newly arrived resident’s waiting period; and (b) before, on or after the commencement of this subsection, the person applied for a visa that is in a class of visas determined by the Minister for the purposes of paragraph 739A(3)(b); the waiting period: (c) starts on the day on which the person applied for that visa; and (d) ends when the person has been in Australia for a period of, or for periods totalling, 208 weeks after that day.
