Section 1061ZZAC — Social Security Act 1991: Secretary’s decision

(1) If a person claims youth allowance, austudy payment or pensioner education supplement, the Secretary must decide whether the person is eligible to obtain financial supplement for a period that is the whole or a part of a year. (2) Also, if: (a) the Secretary has made a decision in a year that a person is eligible to obtain financial supplement for a period that is the whole or a part of that year; and (b) the person is likely to: (i) continue to undertake the person’s tertiary course in the next year; or (ii) undertake a new tertiary course in the next year when enrolments in the course are next accepted; the Secretary must make a new decision, as early as practicable in the next year, about whether the person is eligible to obtain financial supplement for a period that is the whole or a part of that next year. (3) If the Secretary decides that the person is eligible to obtain financial supplement for a period, the Secretary must give the person a notice (a supplement entitlement notice): (a) stating that the person is eligible to obtain financial supplement for that period; and (b) specifying the minimum and maximum amounts of financial supplement that the person can obtain. (4) This section does not apply in relation to a period that is the whole or part of a year if the year begins on or after the day on which the Student Assistance Legislation Amendment Act 2006 receives the Royal Assent.
