Section 1136 — Social Security Act 1991: Need for a request to participate

(1) A person who wants to participate in the home equity access scheme must make a request to participate in accordance with this section. (1A) A request under subsection (1) must: (a) specify any real property that is to be included in working out the value of real assets for the purposes of sections 1133 and 1135A, or that is to be subject to a charge under section 1138; and (b) specify an amount (if any) to be the nominated amount for the purposes of this Division; and (c) specify the rate of the pension (if any) nominated by the person for the purposes of subparagraph 1134(1A)(a)(ii) or (b)(ii). (1B) Paragraphs (1A)(a) and (b) do not apply if subparagraph 1133(1)(d)(ii) or (2)(d)(ii) applied to the person when the person made his or her request to participate in the home equity access scheme. (2) The request must be signed: (a) if the person is not a member of a couple—by the person; or (b) if the person is a member of a couple—by both members of the couple. (3) The request must be: (a) in writing; and (b) in a form approved by the Secretary. Restrictions on requests to participate (4) A person must not make a request if the person is already participating in the home equity access scheme.
