Section 1137 — Social Security Act 1991: Need for a request to later nominate or change nominated amount or rate of pension

(1) A person who is participating in the home equity access scheme and who wants to: (a) nominate an amount to be the nominated amount for the purposes of this Division; or (b) nominate a rate of pension for the purposes of subparagraph 1134(1A)(a)(ii) or (b)(ii); or (c) change the nominated amount earlier specified; or (d) change the rate of the pension earlier specified; must make a request that specifies the nomination or change (as the case may be). (1A) Paragraphs (1)(a) and (c) do not apply if subparagraph 1133(1)(d)(ii) or (2)(d)(ii) applied to the person when the person made his or her request to participate in the home equity access scheme. (2) A request under subsection (1) must be signed: (a) if the person is not a member of a couple—by the person; or (b) if the person is a member of a couple—by both members of the couple. (3) The request must: (a) be in writing; and (b) be in a form approved by the Secretary.
