Section 1141A — Social Security Act 1991: Secretary may cease person’s participation in home equity access scheme

Text of the provision Official document

(1) If: (a) a person is participating in the home equity access scheme; and (b) the Secretary is satisfied that the person ceases to be qualified to participate in the scheme; the Secretary may determine that the scheme ceases to operate in relation to the person. The scheme ceases to operate in relation to the person at the beginning of the first instalment period for the social security pension being paid to the person that begins after the determination is made. Note: For repayment or recovery of the debt owed by the person, see sections 1139 and 1142A. (2) The Secretary must give the person notice of the determination. (3) A determination under subsection (1) is not a legislative instrument.
